New York doctor sentenced for receiving cash kickbacks tied to unnecessary brain scans

The DOJ said Dr. Kenneth Fishberger pleaded guilty in November 2024 to one count of conspiracy to commit health care fraud. The department said he ordered hundreds of medically unnecessary transcranial Doppler scans using false diagnoses and received approximately $100 in cash per test from a mobile diagnostics company principal.

Fishberger was sentenced on 9 December 2025 to two years’ supervised release, including one year of home confinement, and ordered to pay a $50,000 fine, $48,000 forfeiture and $342,876 restitution. The DOJ said the conduct generated approximately $891,978 in fraudulent bills to Medicare and private insurers.
