Clinical laboratory NEXT Bio-Research Services LLC, doing business as NEXT Molecular Analytics, agreed to pay at least $758,000 to resolve False Claims Act allegations, according to the US Department of Justice. The DOJ alleges that NEXT paid doctors in Texas and Arkansas through purported consulting and medical director fees to induce laboratory referrals, and paid independent contractor marketers commissions linked to referral volume and value.
The settlement also resolves allegations that NEXT billed Medicare, Medicaid and TRICARE for tests despite knowledge of the alleged kickbacks. NEXT agreed to cooperate with related investigations; the settlement is not a criminal conviction. Whistleblowers Sunil Wadhwa and Ken Newton will receive $113,700.
