Texas clinic owner convicted in $26 million TRICARE fraud and kickback case

A federal jury convicted Kevin D. Curry, owner of Acuity TMS clinics, on health care fraud, illegal kickback and criminal-money-transaction charges, according to the U.S. Department of Justice. He was convicted on three counts of each offence and has not yet been sentenced.

The DOJ said trial evidence showed that Acuity submitted more than $26 million in allegedly false TMS claims to TRICARE, with approximately $17 million paid, and that Curry offered or paid more than $5.5 million in alleged kickbacks. The DOJ also said records were fabricated and doctors’ credentials used without consent; these underlying conduct descriptions were allegations presented in the case, distinct from the jury’s convictions.
